Article 1 – Definitions
In these Terms and Conditions, the following definitions apply:
- Additional Agreement: An agreement in which the consumer acquires products related to a distance contract, delivered by the entrepreneur or a third party under an agreement with the entrepreneur.
- Cooling-off Period: The period during which the consumer may exercise the right of withdrawal.
- Consumer: A natural person not acting for purposes related to trade, business, craft, or professional activity.
- Day: A calendar day.
- Durable Medium: Any tool that enables the consumer or entrepreneur to store information for future reference and reproduce it unchanged.
- Right of Withdrawal: The consumer's right to cancel a distance contract within the cooling-off period.
- Entrepreneur: The natural or legal person offering products to consumers at a distance.
- Distance Contract: An agreement concluded between the entrepreneur and the consumer through distance communication.
- Means of Distance Communication: Any method used to conclude a contract without the consumer and entrepreneur being in the same place at the same time.

Article 3 – Applicability
- These Terms and Conditions apply to every offer made by Bekhayer and to every distance contract concluded between Bekhayer and the consumer.
- Before a distance contract is concluded, the text of these Terms and Conditions will be made available to the consumer.
- If the contract is concluded electronically, these Terms will be made available in such a way that the consumer can easily store them on a durable medium.
- In the event that specific product or service conditions also apply, the consumer may rely on the provision most favorable to them in case of conflicting terms.
Article 4 – The Offer
- If an offer has a limited duration or special conditions, this will be clearly stated.
- The offer includes a complete and accurate description of the products. Product images are a true representation of the items offered. Obvious errors or mistakes do not bind Bekhayer.
- Each offer contains sufficient information to make clear to the consumer what rights and obligations are attached to accepting the offer.
Article 5 – The Agreement
- The contract is concluded when the consumer accepts the offer and fulfills the stated conditions.
- Upon electronic acceptance, Bekhayer will confirm receipt of the acceptance immediately.
- Bekhayer takes appropriate technical and organizational measures to secure the electronic transfer of data and ensure a safe web environment.
- Bekhayer may assess whether the consumer can meet payment obligations. If there are valid reasons, the entrepreneur may refuse an order or attach special conditions.
- Upon delivery of the product, Bekhayer provides the following information in writing or electronically:
- The business address for complaints.
- The conditions and procedure for exercising the right of withdrawal.
- Information on warranties and after-sales service.
- The total price including taxes and delivery costs.
Article 6 – Right of Withdrawal
- Consumers may cancel a purchase within 14 days of receiving the goods, without providing a reason.
- The withdrawal period begins the day after the consumer (or a third party not being the carrier) receives the product.
- To exercise this right, the consumer must notify Bekhayer via email at info@bekhayer.com within the 14-day period.
Article 7 – Consumer's Obligations During Cooling-off Period
- During the cooling-off period, the consumer must handle the product and packaging with care.
- The consumer may only inspect the product as they would in a physical store.
- The consumer is liable for any reduction in value resulting from handling beyond what is necessary to establish the nature and characteristics of the product.
Article 8 – Exercising the Right of Withdrawal
- To exercise the right of withdrawal, the consumer must notify Bekhayer by email at info@bekhayer.com
- The consumer must return the product within 14 days after notifying Bekhayer.
- Products must be returned in original condition and packaging, including all accessories.
- Return shipping costs are the responsibility of the consumer.
- Bekhayer will confirm receipt of the withdrawal notice electronically.
Article 9 – Obligations of Bekhayer in Case of Withdrawal
- Upon withdrawal, Bekhayer will refund all payments made by the consumer, including standard delivery costs, within 14 days after receiving the withdrawal notice.
- Refunds may be withheld until the returned goods are received or proof of return is provided.
- Refunds will be made using the same payment method used by the consumer unless otherwise agreed.
Article 10 – Exclusions from the Right of Withdrawal
The right of withdrawal does not apply to:
- Products made to the consumer's specifications or personalized.
- Sealed products not suitable for return for health or hygiene reasons, once unsealed (e.g., earrings).
- Products damaged by the consumer after delivery.
Article 11 – Price
- During the validity period stated in the offer, prices will not be increased except due to changes in VAT or legal requirements.
- All prices listed on www.bekhayer.com include VAT.
Article 12 – Compliance and Warranty
- Bekhayer guarantees that products comply with the agreement, the specifications stated in the offer, and reasonable standards of quality and reliability.
- Any additional guarantee provided by suppliers or manufacturers does not affect the consumer's legal rights.
Article 13 – Delivery and Execution
- Bekhayer will take the utmost care in processing and delivering orders.
- The place of delivery is the address provided by the consumer.
- Orders will be executed as quickly as possible and no later than 30 days, unless otherwise agreed.
- If delivery is delayed or cannot be completed, the consumer will be informed within 30 days and may cancel the order free of charge.
- The risk of damage or loss lies with Bekhayer until the product has been delivered to the consumer.
Article 14 – Long-Term Agreements: Duration and Termination
- The consumer may terminate an agreement for an indefinite period at any time, with a notice period of no more than one month.
- Agreements entered for a fixed period may not be automatically renewed for another fixed term.
- For indefinite agreements, the consumer may cancel at any time with a notice period of one month.
Article 15 – Payment
- Unless otherwise specified, all payments must be completed within 14 days after the contract is concluded.
- The consumer must report inaccuracies in payment details immediately.
- If payment is not received on time, Bekhayer may charge statutory interest and reasonable collection costs.
Article 16 – Complaints Procedure
- Bekhayer values customer satisfaction and will handle complaints promptly and fairly.
- Complaints must be submitted via email to info@bekhayer.com, with a clear description of the issue.
- Bekhayer will respond within 14 days of receiving the complaint. If more time is needed, the consumer will be informed of the expected resolution timeline.
Article 17 – Disputes
- All agreements between Bekhayer and the consumer are governed exclusively by Dutch law.
- Disputes will be settled in accordance with Dutch legal procedures.
Article 18 – Additional or Deviating Provisions
- Additional or deviating provisions shall not disadvantage the consumer and must be recorded in writing or on a durable medium accessible to the consumer.
