Article 1 – Definitions

In these Terms and Conditions, the following definitions apply:

  1. Additional Agreement: An agreement in which the consumer acquires products related to a distance contract, delivered by the entrepreneur or a third party under an agreement with the entrepreneur.

  2. Cooling-off Period: The period during which the consumer may exercise the right of withdrawal.

  3. Consumer: A natural person not acting for purposes related to trade, business, craft, or professional activity.

  4. Day: A calendar day.

  5. Durable Medium: Any tool that enables the consumer or entrepreneur to store information for future reference and reproduce it unchanged.

  6. Right of Withdrawal: The consumer’s right to cancel a distance contract within the cooling-off period.

  7. Entrepreneur: The natural or legal person offering products to consumers at a distance.

  8. Distance Contract: An agreement concluded between the entrepreneur and the consumer through distance communication.

  9. Means of Distance Communication: Any method used to conclude a contract without the consumer and entrepreneur being in the same place at the same time.

Article 3 – Applicability

  1. These Terms and Conditions apply to every offer made by Bekhayer and to every distance contract concluded between Bekhayer and the consumer.

  2. Before a distance contract is concluded, the text of these Terms and Conditions will be made available to the consumer.

  3. If the contract is concluded electronically, these Terms will be made available in such a way that the consumer can easily store them on a durable medium.

  4. In the event that specific product or service conditions also apply, the consumer may rely on the provision most favorable to them in case of conflicting terms.

Article 4 – The Offer

  1. If an offer has a limited duration or special conditions, this will be clearly stated.

  2. The offer includes a complete and accurate description of the products. Product images are a true representation of the items offered. Obvious errors or mistakes do not bind Bekhayer.

  3. Each offer contains sufficient information to make clear to the consumer what rights and obligations are attached to accepting the offer.

Article 5 – The Agreement

  1. The contract is concluded when the consumer accepts the offer and fulfills the stated conditions.

  2. Upon electronic acceptance, Bekhayer will confirm receipt of the acceptance immediately.

  3. Bekhayer takes appropriate technical and organizational measures to secure the electronic transfer of data and ensure a safe web environment.

  4. Bekhayer may assess whether the consumer can meet payment obligations. If there are valid reasons, the entrepreneur may refuse an order or attach special conditions.

  5. Upon delivery of the product, Bekhayer provides the following information in writing or electronically:

    • The business address for complaints.

    • The conditions and procedure for exercising the right of withdrawal.

    • Information on warranties and after-sales service.

    • The total price including taxes and delivery costs.

Article 6 – Right of Withdrawal

  1. Consumers may cancel a purchase within 14 days of receiving the goods, without providing a reason.

  2. The withdrawal period begins the day after the consumer (or a third party not being the carrier) receives the product.

  3. To exercise this right, the consumer must notify Bekhayer via email at info@bekhayer.com within the 14-day period.

Article 7 – Consumer’s Obligations During Cooling-off Period

  1. During the cooling-off period, the consumer must handle the product and packaging with care.

  2. The consumer may only inspect the product as they would in a physical store.

  3. The consumer is liable for any reduction in value resulting from handling beyond what is necessary to establish the nature and characteristics of the product.

Article 8 – Exercising the Right of Withdrawal

  1. To exercise the right of withdrawal, the consumer must notify Bekhayer by email at info@bekhayer.com

  2. The consumer must return the product within 14 days after notifying Bekhayer.

  3. Products must be returned in original condition and packaging, including all accessories.

  4. Return shipping costs are the responsibility of the consumer.

  5. Bekhayer will confirm receipt of the withdrawal notice electronically.

Article 9 – Obligations of Bekhayer in Case of Withdrawal

  1. Upon withdrawal, Bekhayer will refund all payments made by the consumer, including standard delivery costs, within 14 days after receiving the withdrawal notice.

  2. Refunds may be withheld until the returned goods are received or proof of return is provided.

  3. Refunds will be made using the same payment method used by the consumer unless otherwise agreed.

Article 10 – Exclusions from the Right of Withdrawal

The right of withdrawal does not apply to:

  1. Products made to the consumer’s specifications or personalized.

  2. Sealed products not suitable for return for health or hygiene reasons, once unsealed (e.g., earrings).

  3. Products damaged by the consumer after delivery.

Article 11 – Price

  1. During the validity period stated in the offer, prices will not be increased except due to changes in VAT or legal requirements.

  2. All prices listed on www.bekhayer.com include VAT.

Article 12 – Compliance and Warranty

  1. Bekhayer guarantees that products comply with the agreement, the specifications stated in the offer, and reasonable standards of quality and reliability.

  2. Any additional guarantee provided by suppliers or manufacturers does not affect the consumer’s legal rights.

Article 13 – Delivery and Execution

  1. Bekhayer will take the utmost care in processing and delivering orders.

  2. The place of delivery is the address provided by the consumer.

  3. Orders will be executed as quickly as possible and no later than 30 days, unless otherwise agreed.

  4. If delivery is delayed or cannot be completed, the consumer will be informed within 30 days and may cancel the order free of charge.

  5. The risk of damage or loss lies with Bekhayer until the product has been delivered to the consumer.

Article 14 – Long-Term Agreements: Duration and Termination

  1. The consumer may terminate an agreement for an indefinite period at any time, with a notice period of no more than one month.

  2. Agreements entered for a fixed period may not be automatically renewed for another fixed term.

  3. For indefinite agreements, the consumer may cancel at any time with a notice period of one month.

Article 15 – Payment

  1. Unless otherwise specified, all payments must be completed within 14 days after the contract is concluded.

  2. The consumer must report inaccuracies in payment details immediately.

  3. If payment is not received on time, Bekhayer may charge statutory interest and reasonable collection costs.

Article 16 – Complaints Procedure

  1. Bekhayer values customer satisfaction and will handle complaints promptly and fairly.

  2. Complaints must be submitted via email to info@bekhayer.com, with a clear description of the issue.

  3. Bekhayer will respond within 14 days of receiving the complaint. If more time is needed, the consumer will be informed of the expected resolution timeline.

Article 17 – Disputes

  1. All agreements between Bekhayer and the consumer are governed exclusively by Dutch law.

  2. Disputes will be settled in accordance with Dutch legal procedures.

Article 18 – Additional or Deviating Provisions

  1. Additional or deviating provisions shall not disadvantage the consumer and must be recorded in writing or on a durable medium accessible to the consumer.
